State and county elections board to transition to GOP control, appeals court rules

A three-judge panel on the North Carolina Court of Appeals has paved the way for Republican State Auditor Dave Boliek to appoint members onto the State Board of Elections and all 100 county boards.

A three-judge panel on the North Carolina Court of Appeals on Wednesday paved the way for Republican Auditor Dave Boliek to transition the State Board of Elections and all 100 county boards of elections from 3-2 Democratic control to 3-2 Republican control.

The judges halted a lower court order that had allowed Democratic Gov. Josh Stein to maintain his appointment authority for the State Board of Elections and all 100 county boards of elections “pending disposition of defendant-appellants' appeal or until further order of this Court.”

Within minutes, Stein blasted the appeals court’s order and asked the 5-2 conservative majority state Supreme Court to step in to prevent Boliek from overseeing the state and county elections boards starting on Thursday.

In a statement, Stein expressed concern that Boliek would move the State Board of Elections to conservative control, which could make it easier for Republican Court of Appeals Judge Jefferson Griffin to overturn an apparent 734-vote defeat to Democratic Supreme Court Justice Allison Riggs.
